1. Who we are
SMOKEMAP (smokemap.online) is run by 9D Industries LLC, a Nevada limited liability company in Las Vegas, Nevada ("we", "us"). By using the site you agree to these Terms and to our Privacy Policy. If you use the site for a business, you agree for that business too.
2. What SMOKEMAP is right now
SMOKEMAP is an early-access information site for an upcoming business-to-business directory and market-intelligence service covering tobacco, vape, and hookah businesses in the United States. At launch it has information pages and a way to ask for early access by email. It has no accounts, no live directory, and no messaging, introduction, or quote-request features. Cannabis and hemp products aren't covered at launch. The Heat Map preview (/heat-map/) shows only county-level totals drawn from public data. It's an illustration of market density, not a business directory, and it may be incomplete or out of date.
3. 21 and older
You must be 21 or older to use SMOKEMAP. That's the U.S. minimum age to buy tobacco and vapor products (Tobacco 21). The site asks you to confirm your age on your first visit. By confirming, you're telling us you're 21 or older; giving a false answer breaks these Terms. If you're under 21, please leave the site.
4. A directory, not a store
- No sales or delivery. We don't sell, buy, broker, ship, or deliver any product, and we don't take orders or payments for products. Any deal you make with a business is between you and that business.
- No endorsements or health claims. Mentioning or featuring a business, brand, product category, or event doesn't mean we endorse it. Nothing on SMOKEMAP is a health claim, a claim that any product is safer or less harmful, or medical advice.
- Businesses are responsible for their own compliance. Each business is responsible for following the federal, state, and local laws that apply to it, including licensing, age verification, product rules, shipping, taxes, and advertising. We don't check or guarantee that any business complies.
5. Using the site
Please don't use SMOKEMAP to break the law, to market tobacco, nicotine, or vapor products to anyone under 21, to interfere with or attack the site, or to scrape or copy it in bulk with automated tools (ordinary search-engine crawling that follows our robots rules is fine). Our marketing pages may be indexed by search engines; the Heat Map preview is not.
6. Material you send us for a listing
If you email us information or material about a business for a future listing (such as a business name, logo, photos, or business details):
- You keep ownership of it.
- You give 9D Industries a non-exclusive, royalty-free permission to use it to build SMOKEMAP and to feature it in our marketing of SMOKEMAP and 9D Industries (for example on our sites, social media, email, ads, and at events), sublicensable only to the platforms and service providers that help us publish it. We don't have to use it, and we may credit you but don't have to.
- You confirm you have the right to send it and to give this permission, and that it's accurate and makes no health claims.
- To opt out, email legal@9dindustries.com. Opting out applies going forward: we'll stop starting new uses within 30 days, and anything already published, scheduled, or printed can stay up.
This permission doesn't affect your privacy rights, described in the Privacy Policy.
7. Our content
The SMOKEMAP site, name, logo, design, text, and graphics belong to 9D Industries or its licensors. Photos credited to others are used under their licenses. Please don't copy or reuse our content or brand without permission, other than sharing a link.
Copyright complaints
If you believe something on SMOKEMAP infringes your copyright, send a notice under the Digital Millennium Copyright Act to our designated agent: Copyright Agent, 9D Industries LLC, 3400 Paradise Rd #88, Las Vegas, NV 89169; phone 702-985-9600; email legal@9dindustries.com. Our agent is registered with the U.S. Copyright Office (DMCA-1083625). Your notice must include your physical or electronic signature, the work you say is infringed, the material and where it appears on the site, your contact information, a statement that you believe in good faith the use isn't authorized, and a statement, under penalty of perjury, that your notice is accurate and that you're the owner or authorized to act for the owner. We may remove material that appears to infringe and will end the access of repeat infringers where appropriate.
8. Disclaimers
SMOKEMAP is provided "as is" and "as available." Information on the site, including any market or industry information, is general and may be incomplete, out of date, or wrong, and it isn't legal, regulatory, tax, medical, or investment advice. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Links to other sites are for convenience; we don't control them.
9. Limitation of liability
To the fullest extent the law allows, 9D Industries and its affiliates, officers, employees, and agents aren't liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, business, data, or goodwill, arising from SMOKEMAP or these Terms. Our total liability for all claims is limited to one hundred U.S. dollars (US$100). Some places don't allow some of these limits; where that's the case, they apply only as far as the law allows.
10. Disputes and governing law
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-laws rules. Please contact legal@9dindustries.com first so we can try to resolve any issue informally. If we can't, any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (hearings may be held by video or phone, or in the county where you live, as those rules provide), except that either side may bring an individual claim in small claims court or ask a court to stop misuse of intellectual property or attacks on the site. You and we each waive jury trials and class or representative actions, to the extent the law allows. For anything not arbitrated, the state and federal courts in Clark County, Nevada have exclusive jurisdiction. We will pay any consumer filing fees beyond the amount the AAA rules assign to you.
11. Changes
We'll update these Terms as SMOKEMAP grows, for example when accounts or a live directory launch. The date at the top shows the latest version. Continuing to use the site after an update means you accept it.
